Native Title Claim Process
The first step in lodging a native title claim is to lodge a ‘native title determination application’ with the Federal Court of Australia.
Please refer to the National Native Title Tribunal website for the requirements and for details of the registration test. The registration test is a set of conditions applied to a native title determination application by the Registrar of the Tribunal. A native title application must satisfy the conditions of the registration test in order for the claimants to get certain rights, for example having a say about proposed developments in the claim area.
A succesful registration enables to claim certain rights, including the right to negotiate, while their claim is in the application stage. It does not give applicants the right to stop projects going ahead, but it does mean that they may have a say about some proposed developments.
