Native Title Services Victoria offers Indigenous claimant groups in Victoria expertise in research to establish the basis for Native Title claims, and expertise in law and mediation to process the claims and to make associated agreements.
Lodging a claim for NTSV Assistance to Native Title Groups
Before assistance can be provided to Indigenous groups, NTSV must assess the potential strength of a claim within the legal framework provided by the Native Title Act. This assessment will depend on a number of factors, including evidence for:
the breadth of support within the group to progress the claim
connection to the claim area through traditional law and custom
the borders of the claim area
any known legal impediment to the claim.
In cases where there is insufficient evidence relating to these issues, NTSV may offer assistance in the form of research or mediation.
Applications should be made in writing and provide as much information as possible in the areas outlined above, including a description of the members of the group.
NTSV considers applications in relation to available resources and to its Operational Plan, as approved by the Commonwealth Government's Office of Indigenous Policy Co-ordination.
Decisions regarding an application for assistance are open to review. For a full statement of procedures, please read our
Guidelines for NTSV Assistance to Native Title Groups (Nov 06).pdf document.
To ensure any concerns are addressed appropriately, NTSV has a comprehensive policy on the handling of complaints. See this link for details:
Handling of Complaints
A Complaints Register is a means by which parties dealing with NTSV may bring to the attention of NTSV issues they feel have not been dealt with appropriately.
